Job Description

Job Summary

The Lead Prosecutor is engaged on a fixed-term consultancy basis for twenty-four (24) months, with possibility for renewal. The role is specifically to lead the prosecution of Operation Black Iron and related ancillary matters on behalf of the Anti-Corruption Commission of Seychelles (ACCS). Reporting to the Principal Counsel, the Lead Prosecutor is responsible for developing and directing the overall prosecution strategy for the case, providing case leadership and technical direction to the Senior Prosecutor, and appearing as lead counsel in court for all preliminary, trial, appellate and ancillary matters connected to the case. The Lead Prosecutor liaises with the Attorney General’s Office, Financial Investigators, Forensic Accountants, and international counterparts on cross-border evidence gathering and mutual legal assistance and provides training and mentoring support to the incoming Legal Advisor to build local capacity within the Legal Unit.

Main Duties & Responsibilities:

  • Lead the development and execution of the prosecution strategy for Operation Black Iron and related ancillary matters, in consultation with the Principal Counsel and the Commissioner.
  • Act as lead counsel in court for all preliminary, trial, and appellate matters connected to the case.
  • Direct and coordinate the case-related work of the Senior Prosecutor, ensuring consistency of approach and adherence to legal and procedural standards.
  • Oversee the collation and presentation of financial transaction evidence and forensic accounting reports in support of the prosecution.
  • Manage disclosure procedures and oversee the preparation and execution of mutual legal assistance requests, joint investigations, and cross-border evidence gathering.
  • Provide technical advice on financial crime investigation and work closely with Financial Investigators, Auditors, and Forensic witnesses.
  • Liaise with the Attorney General’s Office and other institutions as directed on matters relating to the case.
  • Coordinate with national and international agencies on cross-border aspects of the case, including requests for cooperation and evidence sharing.
  • Provide training and mentoring to the Legal Advisor, to build local prosecutorial capacity, in coordination with the Principal Counsel.
  • Prepare and present reports on the progress of the case to the Principal Counsel and Commissioner and as required, to funders and oversight bodies.
  • Ensure compliance with all relevant domestic and international legal instruments throughout the conduct of the prosecution.
  • Perform such other duties directly related to the prosecution of the case as may reasonably be required by the Principal Counsel.
  • In the capacity of the role specific, represent the Commission in external meetings and committees as and when required.
  • Ensure that all work carried out is in accordance with the ethical, moral, and legal standards expected by all employees of ACCS.

Type of position: Fixed-Term Contract (Consultant), twenty-four (24) months, with possibility for renewal.

Job Requirement

Minimum Requirements:

  • Admission, licensing, and current good standing as an attorney at law, barrister, or advocate in a Commonwealth or equivalent jurisdiction.
  • Demonstrable experience in the prosecution of cross-border offences involving money laundering, fraud, corruption, terrorist financing, or other economic crime.
  • A minimum of ten (10) years’ experience in complex financial crime litigation.

Desirable Qualifications & Experience:

  • Experience in the collation and presentation of financial transaction evidence and forensic accounting reports.
  • Experience in the management of disclosure procedures, mutual legal assistance requests, joint investigations, and cross-border evidence gathering and cooperation.
  • A demonstrated ability to provide technical advice on financial crime investigation, and to work effectively with financial investigators, auditors, and forensic witnesses.
  • An in-depth knowledge of domestic and international anti-corruption instruments, including the Anti-Corruption Act, the Anti-Money Laundering and Counter Terrorism Finance Act, the Proceeds of Crime Act, the Mutual Assistance in Criminal Matters Act, the United Nations Convention against Corruption (UNCAC), and the Financial Action Task Force (FATF) recommendations.
  • Experience in the supervision and mentoring of junior counsel or legal advisors, with a view to building local capacity.

Work conditions:

  • Work is performed primarily in an office setting, with regular attendance at court.
  • Must attend court well-prepared for pre-trial, trial, appeal, and ancillary matters, and interact across the criminal justice system.
  • May be required to work weekends and extended hours as and when required by case demands.
  • May be required to travel domestically and internationally to attend to matters relating to mutual legal assistance requests, joint investigations, and cross-border cooperation.

Working hours per week: 8 hours per day, Monday to Friday. The postholder may from time to time be required to work outside normal hours to accommodate court schedules and case requirements.
